Terms of Service
These Terms of Service ("Terms") cover your use of nashpainting.com (the "Website"), which is operated by Nash Painting, LLC ("Nash Painting," "we," "us"). By using the Website you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Website.
1. Using the Website
You must be at least 18 years old to use the Website. Use it only for lawful purposes, and don't use it in a way that could harm the Website, other visitors or Nash Painting.
2. Our content
The text, graphics, logos, photos and software on the Website belong to Nash Painting or its licensors and are protected by copyright, trademark and other laws. Please don't copy, change, distribute or republish them without our written permission.
3. What you send us
When you send us photos, reviews, comments or messages, including photos uploaded to get a price or a color preview, you give Nash Painting a non-exclusive, royalty-free, worldwide license to use, store, copy, adapt and display that content to answer your request, prepare your estimate and run and improve our services. You state that you own the content or have the right to share it.
4. AI previews and preliminary prices
Our chat assistant, color visualizer and online price tools use automated software to give you a quick idea of colors and cost. Previews are illustrations. Real paint and lighting will look different. Prices shown on the Website are not an offer or a contract. For every preliminary price:
This is a preliminary price. It may change until a Nash Painting estimator reviews and certifies your estimate. No deposit, and nothing is final until you approve your written bid.
Only a written bid that you approve is a binding price for your project.
5. Text messages
If you choose to get texts from us, you agree to the following, which is the wording shown next to the opt-in box on our forms: "I agree to receive texts from Nash Painting about my estimate, appointments and project updates. Msg frequency varies; msg & data rates may apply. Reply STOP to opt out, HELP for help. Not required to submit." Opting in is optional and is not a condition of getting an estimate or any service. We may also send a one-time code by text, voice call or email to confirm a booking request made through an AI assistant or flagged by our spam check; it is not marketing and does not opt you in to marketing texts. 6. Links to other websites
The Website may link to websites and services we don't own or control, including our financing partner. We aren't responsible for their content, policies or practices, and you use them at your own risk. Financing is provided by the lender and is subject to credit approval.
7. Limitation of liability
The Website is provided as is. To the fullest extent the law allows, Nash Painting and its directors, employees, partners, agents, suppliers and affiliates are not liable for indirect, incidental, special, consequential or punitive damages, including lost profits, data, use or goodwill, that result from your use of, or inability to use, the Website, or from the conduct or content of any third party on it. This section applies to the Website only. Our painting work is covered by your written bid and our warranty.
8. Governing law
These Terms are governed by the laws of the State of Tennessee, without regard to its conflict-of-law rules.
9. Changes to these Terms
We may update these Terms. When we do, we will post the new version here and change the "Last updated" date above. If you keep using the Website after that, you accept the updated Terms.
